§ 1 Scope of application
§ 1.1 General
The following general terms and conditions apply to all legal transactions with consumers and entrepreneurs with

§ 1.2 Contract
The language available for the conclusion of the contract is German & English. These GTC apply exclusively. I will not recognize any terms and conditions you use that conflict with or deviate from these GTC unless I have expressly agreed to their validity in writing or in text form.
§ 2 Services, prices & terms of payment
§ 2.1 Services
The subject of the contract can be the following services (whereby the list is not exhaustive):-
- Nica Scan & Balancing + Micronutrient Consultation-
- Nica Scan & Balancing for Animals + Micronutrient Consultation-
- 1:1 Coaching
All offers on the Internet are non-binding and do not constitute a legally binding offer to conclude a contract.
§ 2.2 Prices & Invoicing
My prices are shown as net prices plus the statutory value added tax for entrepreneurs, indicated for Germany. For consumers I show the gross amount. An invoice will always be sent to you by e-mail or SMS in the form of a PDF document. For product orders placed on site, you will receive a receipt for bank transfer and an invoice as a PDF. The invoice amount is due immediately upon receipt of the receipt or receipt of the invoice and must be paid to me within 7 days.
The respective services are provided by me in advance and invoiced afterwards. All products in the area of micronutrients can be paid for directly on site in cash or afterwards within the payment period of 7 days with the enclosed invoice or receipt. Interest will be charged for late payments at the agreed rate, as well as costs for appropriate reminders. If the internal dunning process is not successful, I can hand over the outstanding debt to a lawyer for collection. In this case, you will incur costs for the use of legal representation.

General information about Nica Scan & Balancing, micronutrients -
The nica® technology serves exclusively to determine the energetic state of the respective person/animal. I expressly point out that the results do not represent a medical diagnosis and cannot replace it. The nica® system is not a medical product. Statements about the physiological status are by no means possible. The same applies to the micronutrients. They are not medical substitutes and do not replace medically necessary treatments.
General information on 1:1 coaching
My 1:1 coaching is based on cooperation and requires a willingness to learn on your own responsibility. I cannot promise any specific success for these processes. I am merely a process facilitator and provide assistance, patterns and instructions. You alone are responsible for implementation and making decisions.

§ 3.1 Initial consultation
In a preparatory initial meeting between me and you, we lay the foundation for the consulting service. You contact me by e-mail, telephone or contact form. The initial consultation lasts approx. 15 minutes and we will set an appointment based on your concerns. During the initial consultation, we will clarify any questions you may have about the process, content and payment options, as well as whether my offer is suitable for you and your request. Afterwards, you will let me know directly in the meeting or by e-mail whether you would like to work with me.
§ 3.2 Offer
I usually make you a binding offer at the end of our conversation and thus offer you a binding contract. If we are in contact by e-mail or telephone, I will send you a written offer.
§ 3.2 Acceptance, making appointments
With your written confirmation, you accept the offer and the contract is concluded. We agree on a binding date and after completion of my service you will receive an invoice based on the offer and any additional services, such as products or other services that may arise by e-mail.
§ 3.3 Payment agreement, payment options
As a payment option, you can pay in advance, or after completion of the service in cash, by bank transfer or PayPal.the entire invoice amount is due upon commissioning after my service by email.

I will send you a PayPal request with the outstanding invoice amount. This must be transferred within 7 days. When paying via PayPal, we pass on the payment data to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter "PayPal"), as part of the payment processing. PayPal reserves the right to carry out a credit check. PayPal uses the result of the credit check with regard to the statistical probability of non-payment for the purpose of deciding on the provision of the respective payment method. Among other things, address data is included in the calculation of the score values. § 4 Duration and place of service provision
§ 4.1 Nica Scan & Balancing (humans + animals), micronutrients
- The Nica Scan usually takes about 20 minutes.
- The balancing can be booked after the Nica Scan or separately and usually takes about 40 minutes.
- The selection of micronutrient products usually takes place after the Nica Scan and the results.
If the appointment is at the Program House, Brückenstr. 53, 60594 Frankfurt am Main, you can usually take your products with you directly from there. If the appointment takes place in your area, the products will be put together and ordered on site. You will then receive your products within 7 days. The products can also be reordered from me at any time. Delivery times of up to 7 days. Payment for the products is made on the basis of the receipt/invoice that I provide or send to you and is due immediately within 7 days.
§ 4.2 Duration, location 1:1 coaching
The 1:1 coaching can take place on your premises or at the Programmhaus, Brückenstr. 53, Frankfurt am Main. The duration depends on your request, I usually recommend 60 minutes for the first coaching session and each subsequent session by arrangement
§ 4.3 Scope of services, cancellation of appointments
The scope of services depends on the content discussed in advance.
A booked appointment must be canceled at least 48 hours before the start. Otherwise the full fee will be charged.
§ 4.4 Right of withdrawal
As a consumer, you are entitled to a right of withdrawal in accordance with the instructions listed in the appendix. The withdrawal period begins with the conclusion of the contract. The contract is concluded at the moment you receive the confirmation email, text message of the appointment or product order from me.
§ 4.5 Special features
In the case of services such as 1:1 coaching, there are the following special features with regard to the right of withdrawal:
(a) If you order a series of 1:1 coaching sessions and I am to start the service directly or within the 14-day withdrawal period, you waive your right of withdrawal to this extent.
( b) If I start the service before the end of the 14-day withdrawal period. Then be aware that you will lose your right of withdrawal if I provide the service in full. In the case of a pro rata service to you (as the customer) within the revocation period, I am entitled to the consideration (payment) for the service provided - even in the event of revocation.
(c) If the booking is revoked within 14 days and the coaching program has already started during this period, you are only entitled to a pro rata refund of your costs. Services already rendered will then be deducted from the refund on a pro rata basis.
§ 6 Collection, storage and processing of your personal data
I need the following data from you to carry out and process a booking:
- first and last name
- address (optional)
- email address
- for entrepreneurs also company name and VAT ID no.
Which specific data is mandatory can be seen from the mandatory fields depending on the product.
In the case of chargeable services, the name details, in particular the company name, must be correct. The same applies to the address. Invoices are created on the basis of this information. Should corrections be necessary here, this may lead to additional work, which I will charge at a reasonable rate. § 7 Cancellation
I am entitled to cancel agreed appointments if I fall ill at short notice and no replacement can be provided.
In the aforementioned case, we will first try to find an alternative date. If this is not possible, you will be refunded any fees paid in advance.
Cancellations will always be made in writing, or by telephone or email in the event of a last-minute cancellation.
§ 8 Miscellaneous
The law of the Federal Republic of Germany applies exclusively to this contract and its implementation. The Terms and Conditions of Participation shall remain valid and binding in their remaining parts even if individual passages are legally invalid. Ineffective terms and conditions shall be replaced by those that come closest to the economic purpose of the ineffective ones. Agreements deviating from this contract are only effective if they are agreed in writing.
